Overview

This website is operated by Form Beyond Matter. Throughout the site, “we”, “us” and “our” refer to Form Beyond Matter.

These Terms of Service apply when you visit our website, create an account or purchase from us. By using the website or placing an order, you agree to these terms together with our Privacy Policy and Returns & Refunds Policy.

Nothing in these terms affects your statutory consumer rights.

Using our website

You may use this website only for lawful purposes. You must not:

  • Use the website fraudulently or unlawfully
  • Attempt to interfere with its security or operation
  • Introduce viruses, malicious code or other harmful material
  • Scrape, reproduce or commercially exploit its content without permission
  • Use false information when creating an account or placing an order
  • Infringe our rights or the rights of another person

We may restrict access where we reasonably believe the website is being misused.

Products and condition

Form Beyond Matter sells curated vintage, second-hand, archive and contemporary pieces. Unless expressly stated otherwise, items are pre-owned and may display reasonable signs of age or previous wear.

Each item is individually inspected before listing. Significant wear, repairs, alterations or defects identified during inspection will be described and, where possible, photographed.

Colours and proportions may appear slightly different depending on lighting, photography and screen settings. Measurements are approximate and should be compared with a similar item you already own.

The age, price, description and disclosed condition of a second-hand item are relevant when assessing its quality. This does not remove your statutory rights where an item is faulty, materially misdescribed or otherwise fails to meet legal requirements.

Availability

Many products are one-off pieces with only one unit available. Adding an item to your bag does not reserve it.

We take reasonable steps to keep availability accurate, but an item may occasionally become unavailable after an order is placed. If this happens, we will contact you and issue a full refund for the unavailable item.

Sold products may remain visible within the Sold Archive for reference.

Orders

Submitting an order constitutes an offer to purchase the selected products. You will receive an electronic acknowledgement after placing the order.

An order is accepted when we confirm that it has been accepted or dispatched. We may refuse or cancel an order before acceptance where reasonably necessary, including where:

  • The item is unavailable
  • Payment cannot be authorised
  • Pricing or product information contains an obvious error
  • We reasonably suspect fraud or unauthorised activity
  • Delivery to the supplied address is unavailable
  • The order breaches these terms

If payment has already been taken for an order we cannot accept, the relevant amount will be refunded.

Prices and payment

Prices are displayed in the currency selected on the website and include applicable UK taxes where required.

Delivery charges and any other applicable costs will be shown before the order is submitted. International customers may also be responsible for import duties, taxes or customs charges unless the checkout expressly states that these have been collected.

Payment is processed through Shopify and the payment provider selected at checkout. We do not receive or store your complete payment-card details.

Delivery

Available delivery methods, costs and estimated timeframes are shown at checkout.

Orders are sent using the delivery method selected at checkout. Delivery estimates are not guaranteed dates unless expressly agreed with you.

You are responsible for providing a complete and accurate delivery address. Contact us as soon as possible if you notice an error. We cannot guarantee that an address can be changed after dispatch.

Responsibility for the goods passes to you when they are delivered to you or to a person you nominated to receive them.

If a parcel is delayed, lost or arrives damaged, please contact us so that we can investigate with the carrier.

International orders

International orders may be subject to import duties, taxes, customs charges or handling fees imposed by the destination country.

Unless the checkout states that these charges have been collected, they are the customer’s responsibility. Customs processing may also cause delays outside our reasonable control.

Customers are responsible for ensuring that an item can lawfully be imported into their destination country.

Cancellations, returns and refunds

Your cancellation, return and refund rights are explained in our Returns & Refunds Policy.

For most online orders, UK customers may notify us that they wish to cancel within 14 days of receiving the goods and then have a further 14 days to return them.

Customers are responsible for change-of-mind return postage where this was disclosed before purchase. We will cover reasonable return costs where an item is faulty, damaged on arrival or materially misdescribed.

Nothing in these terms restricts any remedy available under the Consumer Rights Act 2015 or other applicable consumer law.

In-person purchases

There is no automatic right to return an item purchased in person solely because you have changed your mind, selected the wrong size or no longer want it.

We may offer an exchange or store credit for an in-person change-of-mind return at our discretion. This does not affect statutory rights relating to faulty or misdescribed goods.

Authentication and sourcing

Items are assessed before listing using the information reasonably available about their labels, production codes, materials, construction, stitching, hardware and documented references. Additional references or specialist opinions may be consulted where appropriate.

Archive production can vary between seasons, regions and factories, and older items may include undocumented repairs or replacement components.

Our assessment process does not exclude or limit your statutory rights if an item is materially misdescribed.

Customer accounts

You are responsible for ensuring that information associated with your customer account is accurate and current.

Shopify’s customer-account system may use email verification or other secure sign-in methods. You should not allow another person to use your account without permission.

Contact us promptly if you believe your account or order information has been accessed without authorisation.

Intellectual property

The website and its original content—including branding, text, graphics, layout, photography and other material created for Form Beyond Matter—belong to us or are used with permission.

You may view and use the website for personal, non-commercial purposes. You may not reproduce, distribute, modify, sell or commercially exploit our original content without written permission.

Product names, brand names and trademarks belonging to third parties remain the property of their respective owners. Their appearance on the website does not imply sponsorship or affiliation.

Third-party services

Our store is hosted by Shopify, and parts of the website may rely on payment providers, delivery companies and other third-party services.

Links to third-party websites are provided for convenience. We are not responsible for external content, availability or practices, although this does not affect any responsibility that the law places on us for fulfilling your order.

Privacy

Our collection and use of personal information is explained in our Privacy Policy.

Optional analytics and marketing technologies are subject to the privacy choices available on the website. Wishlist information is stored locally in the customer’s browser unless otherwise stated.

Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Breach of statutory consumer rights
  • Any other liability that cannot legally be excluded

We are not responsible for losses that were not reasonably foreseeable when the contract was made, or for business losses arising from a consumer purchase.

Nothing in these terms limits any legal remedy available to you where goods are faulty, misdescribed or not supplied with reasonable care.

Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control, including serious carrier disruption, extreme weather, customs delays, industrial action, system outages or governmental restrictions.

Where such an event affects an order, we will take reasonable steps to minimise disruption and keep you informed.

Changes to these terms

We may update these terms to reflect changes to our services, business practices or legal obligations.

The terms applying to an order are those available when that order is placed. Material changes will not retrospectively remove rights already acquired under an accepted order.

Governing law

These terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom or another country, you retain any mandatory rights and protections provided by the laws applicable to you. You may bring proceedings in any court available to you under applicable consumer law.
